Independent advice when the stakes are high
Our Public Works Act practice is focused on advising affected landowners and their professional advisers. We provide independent, objective valuation advice to help owners understand the property and compensation issues arising from an acquisition and ensure those issues are properly identified and assessed.
While our work is undertaken for the landowner, our professional obligation is to form and express an evidence-based valuation opinion. That independence is particularly important where matters are negotiated between valuers, become contested, or may ultimately require expert evidence.
Looking beyond the land acquired
Public Works Act compensation can involve considerably more than the value of the land physically acquired. Depending on the circumstances, relevant issues may include severance, injurious affection, changes in access or configuration, development potential, amenity, disturbance, and the effect of the proposed works on the value and utility of the retained property.
Where the whole property is acquired, the valuation generally disregards the public work and the prospect of acquisition. With a partial acquisition, the retained property may instead be affected by the prospect of imminent works, uncertainty around the project’s final form and effects, and the way those uncertainties are reflected in the market.
We work collaboratively with landowners, legal counsel, compensation advocates, planners, surveyors and other advisers, with a particular emphasis on clear communication and well-reasoned valuation analysis. This helps ensure the property evidence can be understood and used effectively within the wider compensation process.
In most Public Works Act acquisitions, the reasonable cost of obtaining independent valuation and legal advice is typically met by the acquiring authority as part of the compensation process. We can explain how this applies to your circumstances at the outset.
